Terms of Service

1. Acceptance of Terms

By accessing or using the Pushblitz service, managed by BlitzLogic, s. r. o., you agree to be bound by these Terms of Service. If you do not agree to these terms, simply do not use the application.

2. Description of Service

Pushblitz provides an omni-channel push notification SaaS infrastructure allowing customers to manage databases of subscribers, segment audiences, and send push notifications via API or its dashboard.

3. Acceptable Use Policy

Pushblitz provides tools for delivering push notifications. You agree to use the service responsibly and in compliance with all applicable laws.

3.1. Prohibited Conduct

You agree not to use Pushblitz to distribute:

• Illegal content (including but not limited to fraud, piracy, or unlawful goods).
• Spam or unsolicited mass messaging without user consent.
• Misleading or deceptive content (e.g. scams, phishing).
• Malware, viruses, or any malicious software.
• Content that violates third-party intellectual property rights.
• Hate speech, harassment, or discriminatory content.
• Content that violates any applicable laws or regulations.

3.2. Consent Requirements

You must obtain explicit consent from users before subscribing them to push notifications. This consent must be freely given, specific, informed, and unambiguous. You must also provide users with a clear and easy way to revoke their consent at any time.

3.3. Responsibility

You are solely responsible for the content you send through Pushblitz. You must ensure that your use of the service complies with all applicable laws and regulations, including but not limited to data protection laws such as the GDPR. Pushblitz is not responsible for any content sent by users or any consequences arising from such content.

3.4. Enforcement

Pushblitz reserves the right to suspend or terminate accounts that violate these terms and report illegal activities to authorities, without prior notice.

3.5. Reporting Violations

Users can report abuse via contact form or by emailing [email protected].

3.6. Cooperation with Authorities

Pushblitz will cooperate with law enforcement agencies and regulatory authorities to the fullest extent required by applicable laws and regulations.

4. Payment and Billing

Certain plans are billed on a subscription basis (monthly or annually) via our payment provider Stripe. All payments are non-refundable except where legally mandated. If payment fails, your account will enter a suspended or limited state until the billing issue is resolved.

5. Limitation of Liability

BlitzLogic, s. r. o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of the Pushblitz platforms. The service is provided "as is" and "as available".
